Part A · General Provisions

§ 1 Scope

1.1 These General Terms and Conditions (GTC) apply to all contracts between Fabian Nusser e.K., trading as “Maison Talmühle” (hereinafter the “Hotel”), and its customers concerning

  • the rental of suites for accommodation and all further services and supplies provided by the Hotel in this context (hotel accommodation contract, Part B),
  • the use of the “La Source” spa, the panorama pool, the fitness room and the outdoor facilities, as well as spa treatments — by resident guests and by day-spa guests (Part C),
  • the provision of parking spaces in the hotel car park or the hotel garage (Part D).

1.2 These GTC do not apply to package tours within the meaning of Section 651a of the German Civil Code (BGB). The purchase of vouchers in the online shop and spa memberships are governed by the separate terms and conditions available there; these GTC apply in those cases only on a supplementary basis, to the extent that the special terms do not contain a provision.

1.3 The “Customer” is the Hotel’s contracting party — regardless of whether the Customer stays overnight themselves, books for third parties, uses the spa as a day guest or rents a parking space. A “Guest” is any person who actually makes use of the Hotel’s services. The Customer is responsible for ensuring that the guests registered by them comply with these GTC and the house rules.

1.4 The Customer’s own general terms and conditions apply only if this has been expressly agreed in text form.

§ 2 Conclusion of Contract, Contracting Parties

2.1 The contracting parties are the Hotel and the Customer. The contract is concluded upon the Hotel’s acceptance of the Customer’s offer; the Hotel confirms the booking in text form (as a rule, by e-mail).

2.2 For bookings made via the Hotel’s own website, the contract is concluded when the Customer clicks the button “BOOK AND PAY”.

2.3 If the Customer books via a booking portal or a tour operator, that party’s terms and conditions additionally apply to the relationship between the Customer and the portal. The contractual relationship concerning the accommodation exists with the Hotel; the rate and cancellation conditions displayed there form part of this contract.

2.4 Bookings may only be made by persons of legal age. If the Customer books on behalf of third parties, the Customer is jointly and severally liable with them towards the Hotel for all obligations arising from the contract, provided the Hotel holds a corresponding declaration by the Customer.

§ 3 No Right of Withdrawal

3.1 For contracts concerning accommodation for purposes other than residential purposes, and for services related to leisure activities agreed for a specific date or period, consumers have no statutory right of withdrawal (Section 312g (2) no. 9 BGB). This also applies to bookings made via the website, by e-mail or by telephone. Free cancellation is therefore possible only in accordance with § 6.

§ 4 Prices, Payment, Set-Off

4.1 The Customer is obliged to pay the Hotel’s agreed or applicable prices for the provision of the suite and for the further services used by the Customer. This also applies to services commissioned by the Customer directly or through the Hotel which are rendered by third parties and disbursed by the Hotel.

4.2 The agreed prices include the taxes and local charges applicable at the time the contract is concluded. Not included is the visitor’s tax (Kurtaxe) of the municipality of Sasbachwalden, which the Guest owes personally in accordance with the applicable visitor’s tax statutes (available at www.gemeinde-sasbachwalden.de/Rathaus/Buergerservice/Ortsrecht). It is not included in the price shown at the time of online booking; the Hotel collects it on site on behalf of the municipality, states its amount before booking and shows it separately on the invoice. In the event of a change in statutory VAT or the introduction, amendment or abolition of local charges on the subject of performance after conclusion of the contract, prices will be adjusted accordingly. For contracts with consumers this applies only if more than four months lie between conclusion and performance of the contract.

4.3 The amount and due date of a deposit or advance payment follow from the payment conditions of the booked rate, which are displayed to the Customer before booking and repeated in the booking confirmation. The Hotel is entitled to require a reasonable advance payment or security upon conclusion of the contract, in particular in the form of a credit card guarantee. The Hotel is entitled to collect amounts due — in particular the balance remaining after a deposit — at the time stated in the payment conditions of the rate, using the means of payment provided at the time of booking; the Customer is informed of this before booking. In the event of default of payment by the Customer, the statutory provisions apply.

4.4 In justified cases, for example if the Customer is in arrears or the scope of the contract is extended, the Hotel is entitled, even after conclusion of the contract and up to the start of the stay, to require an advance payment or security within the meaning of clause 4.3, or to increase the agreed advance payment or security up to the full agreed remuneration.

4.5 The Hotel is further entitled, at the start of and during the stay, to require a reasonable advance payment or security for existing and future claims arising from the contract, unless such has already been provided under clause 4.3 or 4.4.

4.6 Additional services during the stay (e.g. honesty bar, Le Comptoir, spa treatments, parking) are charged to the room account and settled at the latest upon departure. If payment on invoice has been agreed, the invoice is — unless otherwise agreed — payable without deduction within ten days of receipt.

4.7 The Hotel accepts the means of payment indicated at the time of booking and at the reception desk.

4.8 The Customer may only set off or offset claims against a claim of the Hotel if the Customer’s claim is undisputed or has been finally established by a court of law.

4.9 The Customer agrees that invoices may be transmitted to them electronically.

Part B · Accommodation

§ 5 Services, Use of the Suites

5.1 The Hotel is obliged to keep the booked suite available and to render the agreed services.

5.2 Subletting or re-letting of the suite provided, as well as its use for purposes other than accommodation — in particular for events, commercial photography or filming, or sales purposes — require the Hotel’s prior consent in text form; the right of termination under Section 540 (1) sentence 2 BGB is waived.

5.3 The suite may be occupied by no more than the number of persons stated at the time of booking. Unregistered additional guests — including children — must be notified before arrival. To the extent that the category can accommodate them, the Hotel will charge for them at the price it states in advance.

5.4 A minimum stay may apply for certain periods and rates. It is displayed before booking.

§ 6 Cancellation by the Customer, No-Show

6.1 The Customer may unilaterally withdraw from the contract concluded with the Hotel only if a right of cancellation has been expressly agreed in the contract or a statutory right of withdrawal or termination exists.

6.2 The conditions for free cancellation depend on the booked rate. They are displayed to the Customer before completion of the booking and repeated in the booking confirmation. If a deadline for free cancellation has been agreed accordingly, the Customer may withdraw from the contract up to that deadline without triggering any payment or damages claims by the Hotel. The right of cancellation lapses if the Customer does not exercise it by the agreed deadline, either vis-à-vis the Hotel in text form (e-mail suffices) or via the online cancellation in the booking confirmation.

6.3 For rates expressly designated as non-refundable (e.g. “Advantage rate – non-refundable”), free cancellation is excluded. The price advantage granted for these rates is the consideration for waiving the right of cancellation.

6.4 If no right of cancellation has been agreed or it has already lapsed, and no statutory right of withdrawal or termination exists, the Hotel retains its claim to the agreed remuneration even though the service is not used. This also applies in the event of non-arrival without cancellation (no-show) and early departure. The Hotel must credit the income from renting the suite to other parties as well as saved expenses. If the suite is not rented to other parties, the Hotel may apply a flat-rate deduction for saved expenses. In that case the Customer is obliged to pay 80% of the contractually agreed price for accommodation with breakfast and for packages including third-party services. The Customer remains free to prove that the aforementioned claim did not arise, or did not arise in the amount demanded.

6.5 The Hotel will set off a deposit already paid against its claim under clause 6.4. Overpayments are refunded without undue delay, at the latest within 14 days.

6.6 The Hotel recommends taking out travel cancellation insurance.

§ 7 Cancellation by the Hotel

7.1 If it has been agreed that the Customer may withdraw from the contract free of charge within a certain period, the Hotel is for its part entitled during that period to withdraw from the contract if there are enquiries from other customers for the contractually booked suite and the Customer, upon enquiry by the Hotel with a reasonable deadline, does not waive their right of cancellation. This applies accordingly where an option has been granted, if other enquiries exist and the Customer, upon enquiry by the Hotel with a reasonable deadline, is not prepared to make a firm booking.

7.2 If an advance payment or security agreed or required under clause 4.3 or 4.4 is not provided even after expiry of a reasonable grace period set by the Hotel, the Hotel is likewise entitled to withdraw from the contract.

7.3 Furthermore, the Hotel is entitled to withdraw from the contract extraordinarily for objectively justified reasons, in particular if

  • force majeure or other circumstances for which the Hotel is not responsible make performance of the contract impossible;
  • suites or rooms are culpably booked on the basis of misleading or false statements or the concealment of material facts; material facts may include the identity of the Customer, their ability to pay or the purpose of the stay;
  • the Hotel has reasonable grounds to believe that use of the service may jeopardise the smooth operation of the business, the safety of the Hotel or its public reputation, without this being attributable to the Hotel’s sphere of control or organisation;
  • the purpose or occasion of the stay is unlawful;
  • there is a breach of clause 5.2.

7.4 Justified cancellation by the Hotel does not give rise to any claim for damages on the part of the Customer. Payments already made for services not rendered will be refunded by the Hotel.

§ 8 Provision, Handover and Return of the Suite

8.1 The Customer does not acquire any claim to the provision of a specific suite unless this has been expressly agreed in text form. A category is booked; the Hotel may allocate an equivalent or higher-value suite of the same category.

8.2 Booked suites are available to the Customer from 3:00 p.m. on the agreed day of arrival. The Customer has no claim to earlier availability.

8.3 On the agreed day of departure, the suite must be vacated and made available to the Hotel by 11:00 a.m. at the latest, unless a later check-out has been agreed (late check-out). Thereafter, the Hotel may charge 50% of the accommodation price agreed for the last night for use exceeding the contract until 6:00 p.m., and 90% from 6:00 p.m. onwards. This does not establish any contractual claims of the Customer. The Customer remains free to prove that the Hotel incurred no claim to a usage fee, or a substantially lower one.

§ 9 Pets

9.1 Dogs may be brought into the suites designated for this purpose with the Hotel’s prior consent in text form, with a maximum of one dog per suite. Booking a dog via the Hotel’s booking process constitutes such consent. The Hotel charges a fee per night, which it states at the time of booking or when giving its consent; this fee covers the customary additional cleaning. Other animals are not permitted.

9.2 Assistance dogs within the meaning of Section 12e of the German Act on Equal Opportunities for Persons with Disabilities (Behindertengleichstellungsgesetz) are, irrespective of clause 9.1, admitted in all areas where this is permissible under hygiene law; no fee is charged for them.

9.3 Dogs are not permitted in the spa, pool and fitness areas. The Customer is liable under § 20 for any damage caused by their dog to the building, furnishings or inventory.

§ 10 House Rules

10.1 The house rules form part of this contract. They are available in every suite, at the reception desk and on the website. The following rules apply in any event.

Smoking

10.2 Smoking is prohibited in all indoor areas of the Hotel — including suites, corridors, and the spa and fitness areas. The prohibition includes e-cigarettes, vaporisers, shishas and comparable products. Smoking is permitted exclusively on the balconies of the suites; the ashtrays provided there must be used. In the event of a violation, the Hotel charges a flat-rate amount of €250 for the special cleaning required (odour neutralisation, cleaning of textiles and upholstery). The Customer remains free to prove that no costs, or substantially lower costs, were incurred. If the suite cannot be re-let in time as a result, the Hotel may additionally claim the proven loss of rental income.

Quiet hours

10.3 Night-time quiet applies throughout the Hotel from 10:00 p.m. to 7:00 a.m.; in the spa, quiet applies at all times.

Batteries and e-mobility

10.4 For fire-safety reasons, charging e-bikes, e-scooters and comparable devices with lithium-ion batteries in the suites is not permitted. Designated charging facilities are available for this purpose. Mobile phones, laptops and comparable small devices are not covered by this rule.

Minors

10.5 Parents and legal guardians supervise accompanying minors and are liable under the statutory provisions for damage caused by them. For the spa, pool and fitness room, the rules in Part C additionally apply.

Consequences of violations

10.6 If a guest, despite a warning, seriously violates the house rules or persistently disturbs the peace of the house, the Hotel may terminate the contract without notice for good cause. Clause 6.4 applies accordingly.

§ 11 Group Bookings

11.1 For bookings of five or more suites for the same period, separate conditions apply — in particular regarding deposit, cancellation and rooming list — which are agreed in the individual contract. To the extent that the individual contract contains no provision, these GTC apply.

§ 12 Opening Phase

12.1 The Hotel is expected to open on 28 January 2027. For stays with arrival up to and including 31 July 2027, the following provisions additionally apply.

12.2 If the Hotel cannot provide the booked service on the agreed date due to delayed completion, outstanding official acceptances or permits, or unfinished furnishing works, it will inform the Customer without undue delay after becoming aware, at the latest 30 days before the agreed day of arrival. The Customer may then withdraw from the contract free of charge or rebook to a later date. Payments already made will be refunded in full by the Hotel within 14 days.

12.3 If the booked suite is not completed in time, the Hotel may rebook the Customer into an equivalent or higher-value suite without any change in price. Rebooking into a lower-value suite requires the Customer’s consent and leads to a corresponding price reduction.

12.4 If individual facilities (such as parts of the spa or the outdoor areas) are not yet available, or only available to a limited extent, during the opening phase, the Hotel will notify this before conclusion of the contract or without undue delay after becoming aware. The Customer’s statutory warranty rights remain unaffected.

12.5 Further claims by the Customer on account of a postponement under clause 12.2 are excluded, unless the Hotel caused the delay intentionally or through gross negligence, or culpably informed the Customer too late. Liability for damages arising from injury to life, body or health remains unaffected.

Part C · “La Source” Spa, Panorama Pool, Fitness

§ 13 Use

13.1 The spa, panorama pool, fitness room and outdoor facilities are available to resident guests and registered day-spa guests during the posted opening hours. Opening hours are announced in the house, on the website and at the time of booking. Use outside opening hours is not permitted; any lighting of the facilities outside opening hours serves design and safety purposes only and does not constitute a release for use.

13.2 Day-spa guests are granted access only after prior booking and registration at the reception desk.

13.3 The spa, pool and fitness room are operated without lifeguard supervision. Use is at the Guest’s own responsibility, observing the posted safety instructions and the house rules for spa and pool. Before use, every guest must familiarise themselves with the local conditions, in particular the water depth of the panorama pool (approx. 0.60 m to 1.34 m). Jumping and diving are not permitted.

13.4 The Hotel may refuse use to guests who are recognisably under the influence of alcohol or other intoxicating substances. Glass is not permitted in the pool and sauna areas.

§ 14 Children and Adolescents

14.1 The spa and sauna area is reserved for guests aged 18 and over. Daily from 10:00 a.m. to 12:00 noon (Kids’ Hour), children and adolescents under 18 may use it under the constant supervision of a parent or legal guardian.

14.2 Children and adolescents under 18 may use the panorama pool only under the constant supervision of a parent or legal guardian or an adult supervisor appointed by them. The same applies to the fitness room.

14.3 The duty of supervision lies exclusively with the parents or legal guardians or the supervisor appointed by them; the Hotel does not assume any supervision or care. In the event of violations of the accompaniment requirement, the Hotel may refuse minors access.

§ 15 Spa Treatments

15.1 Treatments can be booked in advance or during the stay. Each booking constitutes a separate service contract.

15.2 A treatment may be cancelled free of charge up to 24 hours before the agreed appointment. In the event of later cancellation or failure to appear, the Hotel charges 80% of the treatment price. The Customer remains free to prove that the Hotel incurred no loss, or a substantially lower loss; if the appointment can be given to another party, the fee does not apply.

15.3 In the event of late arrival, the treatment time is shortened accordingly; the full price is charged unless the delay is attributable to the Hotel.

15.4 Before the treatment, the Guest shall disclose any health restrictions that may be relevant to the treatment (such as pregnancy, cardiovascular conditions, allergies). In the event of medical concerns, the Hotel may decline a treatment; in that case no costs are incurred.

15.5 The purchase of day-spa admissions and treatments via the online shop is additionally governed by the terms and conditions there.

Part D · Parking Spaces (Hotel Car Park, Hotel Garage)

§ 16 Provision, Use

16.1 Upon entering the hotel car park or the hotel garage (hereinafter the “parking area”), the Hotel provides the Customer with a parking space for the duration of their stay or visit. Neither guarding nor safekeeping are the subject of this provision; the Hotel assumes no custody or special duties of care for the vehicles and items parked.

16.2 The Customer must exercise the care required in traffic. The German Road Traffic Regulations (StVO) apply accordingly. Only walking speed is permitted in the parking area. Instructions given by hotel staff serving safety purposes or relating to the Hotel’s domestic authority must be followed without delay.

16.3 Vehicles may be parked only within the marked parking spaces, and not on reserved or specially designated spaces (e.g. for persons with disabilities or for charging, unless charging is in progress). The Hotel may have incorrectly parked vehicles relocated at the Customer’s expense — in cases of imminent danger also without prior notification. The Customer or vehicle keeper bears the actual costs incurred by the towing company engaged.

16.4 The following are not permitted in the parking area: smoking and open fire; the storage of fuels and flammable items; unnecessarily running engines; parking vehicles with leaking tanks; refuelling, repairing, washing or interior cleaning of vehicles; draining coolant, fuels or oils; distributing advertising material. Presence in the parking area is permitted only for parking and unparking, and for loading and unloading. The Customer must remove any soiling without undue delay.

16.5 The Hotel recommends always locking vehicles and leaving no valuables inside.

§ 17 Authorised Users, Parking Duration, Charging Stations

17.1 Parking spaces are available free of charge to resident guests during their stay and to day-spa guests on the day of their visit, subject to availability; there is no entitlement to a parking space. Other persons are not permitted to park; the Hotel may have vehicles parked without authorisation removed at the keeper’s expense.

17.2 The maximum parking duration is, for resident guests, the booked stay including the days of arrival and departure, and for day-spa guests the day of their visit, unless otherwise agreed. Thereafter, the Hotel may have the vehicle removed at the Customer’s expense, provided the Customer and/or keeper was previously notified in text form with a deadline of at least two weeks and this remained without result, or the value of the vehicle obviously does not exceed the parking fee due.

17.3 Each vehicle may occupy only one parking space.

17.4 The Hotel operates charging points for electric and hybrid vehicles. Charging is subject to a fee; the price per kilowatt-hour is displayed at the charging station. For resident guests the fee is charged to the room account; day-spa guests pay on site. Charging spaces may be occupied only while charging is in progress; there is no entitlement to a free charging point or a particular charging capacity.

§ 18 Liability for Vehicles, Parking Service, Removal

18.1 The Hotel is liable for damage to parked vehicles and their contents only in accordance with § 19.

18.2 The Hotel is not liable for damage caused by other customers or other third parties, in particular not for damage to, destruction of or theft of the vehicle or of items in or on the vehicle, unless the Hotel has breached its obligations under § 19.

18.3 If the Hotel takes over parking or unparking at the request of a resident guest, this is done as a courtesy; no safekeeping contract or duty of surveillance arises as a result. Damage to other vehicles or property is to be settled via the vehicle keeper’s motor liability insurance. The Hotel and the driver engaged by it are liable for damage to the Customer’s vehicle and for disadvantages arising from settlement via the Customer’s insurance (deductible, premium increase) only in cases of intent or gross negligence. If the Customer and the keeper are not identical, the Customer indemnifies the Hotel and the driver to this extent against claims by the keeper.

18.4 Damage must be reported to the Hotel without undue delay in text form and before the vehicle is removed from the parking area. The Customer is liable for damage culpably caused to the Hotel by the Customer, their agents or accompanying persons, and for cleaning costs in the event of soiling under clause 16.4; the Customer reports such damage before leaving the parking area.

18.5 The Hotel may remove and realise vehicles or trailers without an official registration plate if this was previously threatened vis-à-vis the Customer or keeper and they failed to comply with a request for removal within a reasonable period; no threat is required if the Customer or keeper cannot be identified even after reasonable efforts. Any realisation proceeds, less costs, are due to the Customer or keeper.

Part E · Liability and Final Provisions

§ 19 Liability of the Hotel

19.1 The Hotel is liable for damage for which it is responsible arising from injury to life, body or health. It is further liable for other damage based on an intentional or grossly negligent breach of duty by the Hotel, or on an intentional or negligent breach of obligations typical of the contract. Obligations typical of the contract are those obligations which make proper performance of the contract possible in the first place and on whose fulfilment the Customer relies and may rely. A breach of duty by a legal representative or vicarious agent is equivalent to a breach of duty by the Hotel. Further claims for damages are excluded, unless otherwise provided in this § 19.

19.2 Should disruptions or defects occur in the Hotel’s services, the Hotel will endeavour to remedy them upon becoming aware of them or upon the Customer’s prompt complaint. The Customer is obliged to contribute what is reasonable for them to remedy the disruption and keep any possible damage to a minimum.

19.3 For items brought in, the Hotel is liable to the Customer in accordance with the statutory provisions (Sections 701 et seq. BGB). The Hotel recommends using the in-room safe. If the Customer wishes to bring in money, securities or valuables worth more than €800, or other items worth more than €3,500, this requires a separate safekeeping agreement with the Hotel.

19.4 Wake-up calls are carried out with the greatest care. Messages for guests are handled with care. The Hotel may, by prior arrangement, take on the acceptance, storage and — on request, for a fee — forwarding of mail and consignments of goods; in doing so it is liable only in accordance with clause 19.1.

19.5 Items left behind are forwarded only on request and at the Guest’s risk and expense. The Hotel stores them for six months; thereafter, items of recognisable value are handed over to the local lost-property office.

§ 20 Liability of the Customer

20.1 The Customer is liable under the statutory provisions for damage to the building, furnishings and inventory culpably caused by the Customer, their accompanying persons or other persons within their sphere of responsibility. Damage must be reported to the Hotel without undue delay.

20.2 The Hotel may require security under clause 4.5 for the anticipated costs of remedying damage and may draw on a deposited payment guarantee after notifying the Customer of the damage and the cost estimate in text form.

§ 21 Force Majeure

21.1 If performance becomes impossible for one or both parties due to force majeure (such as natural events, epidemics, official orders, war, strikes in third-party businesses), both parties are released from their performance obligations for the duration and to the extent of the impact. Payments already made for services not rendered will be refunded. The parties’ statutory rights otherwise remain unaffected.

§ 22 Data Protection

22.1 The Hotel processes personal data in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act, in particular for the performance of the contract and for compliance with statutory obligations (e.g. registration obligations under the German Federal Registration Act, retention for tax purposes). Details are set out in the privacy policy on the website.

§ 23 Final Provisions

23.1 Amendments and additions to the contract, to the acceptance of the offer or to these GTC should be made in text form. Unilateral amendments or additions are invalid.

23.2 The place of performance and payment is the Hotel’s registered seat in Sasbachwalden.

23.3 If the Customer is a merchant or a legal entity under public law, the exclusive place of jurisdiction is Achern. The Hotel may, at its option, also sue the Customer at the Customer’s seat. The same applies to customers not covered by sentence 1 if their seat or place of residence is not in a member state of the EU.

23.4 German law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Vis-à-vis consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state of their habitual residence.

23.5 The Hotel is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

23.6 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provisions.

23.7 The version of these GTC valid at the time of the booking confirmation is authoritative. In the event of discrepancies between the German version and translations, the German version prevails.
